Dear Mr. President of the European Parliament,

On behalf of the National Union of Road Hauliers from Romania (UNTRR) – employers’ professional organization which promotes nationally and internationally the interests of Romanian transport companies performing road transport of passengers and goods,

We would like to inform you hereby concerning the protest action to be organized by UNTRR Romania together with our colleague associations from Czech Republic, Hungary and Poland on 25 March 2015, from 14h00 to 16h00 in front of the European Parliament in Brussels, at Place du Luxemburg. We will protest against neo-protectionism in European road transport, asking for European Parliament’s support to urgently cancel the application of German minimum wage law – MiLoG and the similar French law draft – Macron to the road transport companies from our countries. The translated text of the letter addressed to Angela Merkel which ZMDP Poland submitted at the German Embassy during the protest on 4th of March

The Polish road carriers call for the verification of regulations concerning the minimal wage with respect to drivers performing cross-border, transit or cabotage carriage in Germany.

The inclusion of the drivers employed in companies in Poland into the MiLoG provisions violates our sense of sovereignty. When our country joined the European Union, we were happy for the perspectives of the free movement of goods and services. We greeted the German investments in our country with understanding, and we, ourselves, had taken difficulty and risk of competing for strong position in the common market. MiLoG is a blow to the fundamental European values. It breaks the long-term cooperative relations with the German partners, it increases the costs of trade, especially between Germany and the east of Europe, it imposes on us the obligation to keep records of our companies in a foreign language and the obligation to be subject to the control of authorities of a foreign state. The European Union had been created as a community of economic interests, in which every state sacrificed some part of its own benefits for the construction of the common good. MiLoG is a step in the opposite direction, is an attempt of imposing own particular interests to others. The Polish road carriers are deeply disappointed by the introduction of those protectionist provisions. We imagine the freedom of conducting business in Europe differently.

UNTRR’s actions against the application of the minimum wage in Germany

The National Union of Road Hauliers from Romania – UNTRR- made numerous interventions to Romanian, German and European authorities, and to the relevant national and international institutions:

– requesting clarification on the enforcement of the minimum wage law in Germany to foreign carriers (Romanians);

– calling for urgent action to avoid penalizing abusively the Romanian road transport operators by the German authorities as of 1st January 2015, due to non-apllication of the German minimum wage law;

– indicating the seriousness of the recent measures taken by Germany, which affect the freedom of services in the European market and warning that the enforcement of such measures pushes Europe on a path of neoprotectionism which ultimately will affect its overall competitiveness over other global competitors. Recent protectionist measures in UE

Finland

 On 25 April 2013, a regulation came into force stating that under cabotage, following termination of a transportation operation in Finland, haulage companies based in EU Member States have been allowed to conduct a maximum of three haulage operations in a 7-day period and no more than 10 operations in a period of three months. Customers have a legal obligation to ensure that cabotage regulations are being complied with. Both the police and customs officials are acting as monitors. Haulage vehicles have to carry the international CMR freight consignment note and present this to police officers on request. The extended use of foreign vehicles for transportation operations within Finland under legal cabotage is not permitted, as they have to be registered in Finland within seven days of their importation. I am sure you did a lot related to internal oganisation of EU, or at least you tried.

Protest at the embassies of Germany and France

UNTRR organized a protest at the embassies of Germany and France in Bucharest

BUCHAREST, March 18, 2015 – National Union of Road Hauliers from Romania (UNTRR) organized, on March 18, a protest at the embassies of Germany and France concerning the introduction of the minimum wage for Romanian companies engaged in international transport operations to / from, or transiting the territory of the two countries. So far, UNTRR has made numerous approaches at the national, European and international level against the minimum wage laws in Germany (MiLoG) and France (Macron) which are affecting the Romanian hauliers, warning that they alter the free movement of services within the European Union.
